Terms & Conditions

1. Parties & agreement

This agreement is entered into between The Wedding Web Co. ("the Service Provider", "we", "us") and the client named on this signed contract ("the Client", "you"). By signing electronically, you confirm that the details you have provided are accurate and that you have authority to enter into this agreement.

2. Scope of work

We will design and build a bespoke wedding website in line with the selected package and the details supplied in your questionnaire. The package inclusions listed on our website form part of this agreement. Any add-ons, custom functionality or work outside the selected package scope will be quoted and agreed separately before it begins.

3. Client responsibilities & content

You are responsible for providing accurate content (text, images, guest details and wedding information) in a timely manner. You confirm that you own or have the right to use all content and images supplied, and you indemnify us against any third-party claims arising from content you provide. Delays in supplying content may delay your go-live date.

4. Timelines & project delays

Estimated timelines are provided once we receive your completed questionnaire and content. Timelines are estimates, not guarantees, and depend on your responsiveness and the complexity of the build. If a project is inactive on your side for more than 30 days, we may pause it and reschedule based on our availability.

5. Revisions & edits

Each package includes a set number of free edits as listed for that package. Additional edits are billed per our published edit bundles (R250 / 5, R500 / 10, R750 / 15). Major redesigns, structural changes or new sections beyond the agreed scope are quoted separately.

6. Payment & pricing

The total price is the amount shown on this signed contract, including any discount applied. You may pay upfront in one payment via our secure payment gateway, or in 3 equal monthly instalments via EFT (by selecting the EFT option). All prices are in South African Rand (ZAR).

7. No refunds

All payments are strictly non-refundable. Because each website is custom-built and work begins as soon as your project is confirmed, no refunds will be given once payment (or any instalment) has been made, including if you cancel, postpone or call off the wedding.

8. Go-live condition

Your website will only be published and go live once payment has been received in full. For instalment arrangements, the website goes live after the final instalment has cleared. We reserve the right to suspend a live site if an agreed instalment is not paid.

9. Discount lock-in

Choosing the EFT instalment option (or paying upfront) while your limited-time 25% discount is still active locks in that discount for the full order. If the timer has ended, any valid one-time coupon discount you hold still applies. Discounts cannot be claimed retroactively once expired.

10. First-year hosting (included)

The first year of hosting is included free with every package, with no monthly fees during that first year. After the first year, hosting renews at our then-current annual hosting rate, which we will confirm with you before renewal. If hosting is not renewed, the website may be taken offline.

11. Domains & personal email addresses (additional cost)

Personal / custom email addresses (e.g. you@yourdomain.co.za) are NOT included in any package and are an optional add-on charged separately, including any ongoing annual mailbox or provider fees. Custom domain registration and annual domain renewal fees, where applicable, are also billed separately and are your responsibility.

12. Service levels & support (SLA)

We provide reasonable-effort support during South African business hours (Mon–Fri, excluding public holidays). We aim to acknowledge support requests within 2 business days. While we take care to keep sites available, we do not guarantee uninterrupted, error-free or 100% uptime service, as hosting and third-party infrastructure are outside our direct control. Scheduled maintenance may occasionally require brief downtime.

13. Third-party services

The website may rely on third-party services (hosting, domain registrars, payment gateways, email providers, analytics). We are not liable for outages, changes, price increases or discontinuation of those third-party services. Their own terms and pricing apply.

14. Intellectual property

You retain ownership of the content and images you supply. On full payment, you receive a licence to use the completed website for your wedding. Underlying code, design systems, templates and tools remain the intellectual property of The Wedding Web Co. We may showcase the completed website in our portfolio unless you request otherwise in writing.

15. Limitation of liability

To the maximum extent permitted by law, our total liability under this agreement is limited to the total amount you have actually paid us for the affected project. We are not liable for indirect, incidental or consequential losses, loss of data, loss of profit, or any loss arising from guest actions, third-party services or your supplied content.

16. Data protection & POPIA

We process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA). Information you and your guests submit (e.g. names, contact details, RSVP and dietary information) is collected solely to build, operate and support your wedding website. We apply reasonable security safeguards, do not sell personal information, and share it only with service providers necessary to deliver the service. You are the responsible party for your guests' information and confirm you have a lawful basis to collect it. You may request access to, correction of, or deletion of your personal information after the project, subject to legal and operational retention requirements.

17. Confidentiality

Both parties will keep non-public information shared during the project confidential and use it only to perform this agreement.

18. Termination

Either party may terminate this agreement in writing if the other materially breaches it and fails to remedy the breach within 14 days of notice. On termination, amounts already paid remain non-refundable and any work completed up to that point remains payable.

19. Governing law

This agreement is governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts.
